 중국은 정부의 관용적인 방임 정책에 힘입어 2010년 이후 디지털 플랫폼경제가 급성장해, 2010년대 후반이 되면 미국 다음가는 디지털 플랫폼 강국이 되었다. 플랫폼경제의 성장은 중국 전체 경제의 성장과 소비자 편익, 취업 증대에 큰 공헌을 하였다. 그런데 2020년 말부터 갑자기 중국 당국은 플랫폼경제에 대한 규제 강화의 방향으로 정책을 전환하였다. 이 속에서 2022년 6월, 14년간 시행되어 온 <반독점법>이 개정되었다. 개정의 핵심은 플랫폼경제에 대한 여러 규율 조항을 새로 추가한 것이다. 본 연구는 플랫폼경제에 대한 독점 규제에 초점을 맞추어 개정 <반독점법>의 주요 내용을 분석하였다. 우선 II절에서는 2021년 플랫폼경제에 대한 규제 강화 정책이 취해진 배경과 주요 조치를 고찰하였다. 이어 III절에서는 <반독점법> 개정의 경과와 개정된 <반독점법>의 체제를 고찰하였다. IV절에서는 개정 <반독점법>의 법 조항 분석을 통해 플랫폼경제에 대한 독점 규제의 내용을 ①총칙, ②독점협의, ③시장지배지위 남용, ④경영자집중(기업결합), ⑤법률책임의 강화 파트로 나누어 구체적으로 고찰하였다. V절 맺음말에서는 ‘강력한 관리감독’에서 ‘상시화된 관리감독’ 및 ‘적극적 발전 지원’으로 전환한 규제 정책의 최근 변화 추세와 전망을 제시하였다.
Abstract Thanks to the government's permissive policy, China's digital platform economy grew rapidly, and by the late 2010s, it had become a digital platform powerhouse next to the United States. However, from the end of 2020, the Chinese government suddenly changed their policy to strengthen regulations on the platform economy. In this, the was revised in June 2022. The core of the revision is the addition of several new regulatory provisions for the platform economy. This study analyzed the main contents of the revised , focusing on monopoly regulation on the platform economy. Section II examined the background and major measures taken to strengthen regulations on the platform economy in 2021. Section III examined the progress of the revision and the system of the revised . Section IV, through the analysis of the legal provisions of the revised , examined the contents of monopoly regulation on the platform economy in detail by dividing them into ①general provisions, ②monopoly agreement, ③abuse of market dominance, ④operator concentration, and ⑤strengthening legal responsibility. In the concluding remarks of Section V, recent trends in regulatory policy was considered.
